Catherine Hoggle was back in court Thursday ahead of her double murder trial in the deaths of her two youngest children.
Prosecutors are fighting her plan to use an insanity defense.
Hoggle, of Montgomery County, Maryland, is charged with two counts of murder in the 2014 deaths of her children Sarah, 3, and Jacob, 2. Hoggle’s children disappeared nearly 12 years ago. Their bodies have never been found.
Hoggle’s attorney has said she plans to plead not criminally responsible.
Prosecutors say her attorneys waited seven months too long to enter the plea.
In new court filings, her attorneys are explaining why. They say they haven’t received documents in the case or medical records from a state psychiatric facility where she’s being held. They say they need the documents and other evidence in the case in order to provide her with effective legal advice.
State’s Attorney John McCarthy has said the insanity plea could cause the trial to be delayed, which he said would be torture for Sarah and Jacob’s other family members.
